By using Claybird, you agree to these terms. If you don't agree, you may not use our services.
1. What We Do
Claybird provides an AI-powered growth platform for commercial service businesses. This includes lead generation, prospecting automation, and customer relationship management tools.
2. Your Account
When you create an account, provide accurate information and keep your credentials secure. You're responsible for everything that happens under your account. If you notice unauthorized access, tell us immediately.
3. Text Messages
If you opt in to receive texts, here's what that means:
Consent
You'll receive texts about support, account updates, and service notifications. Opting in is not required to use Claybird.
Frequency and Rates
Message frequency varies. Standard message and data rates apply—check with your carrier.
Opt Out
Reply "STOP" to any message to opt out. You'll get one confirmation text, then nothing else unless you opt back in.
Help
Reply "HELP" or email team@claybird.com for support.
Delivery
We can't control carrier delivery. Messages may be delayed or fail to arrive—that's on your carrier, not us.
Privacy
We don't share your mobile data with third parties for marketing. See our Privacy Policy for details.
4. What You Can't Do
Don't:
- Use our services for anything illegal
- Violate laws or regulations
- Infringe on others' rights
- Send spam, malware, or harmful content
- Try to access our systems without permission
- Disrupt or interfere with our services
- Harass, abuse, or harm anyone
- Reverse engineer or extract our code
5. Ownership
Everything in our services—text, graphics, logos, software—belongs to Claybird or our licensors. Don't copy, modify, or redistribute without permission.
6. Payment
If you subscribe to a paid plan, you agree to pay all fees. We bill in advance, charge your payment method automatically, and don't offer refunds unless we say otherwise. We can change pricing with notice.
7. No Warranties
Our services are provided "as is" without warranties of any kind. We don't guarantee that our services will be error-free, uninterrupted, secure, or accurate.
Use at your own risk.
8. Limits on Liability
We're not liable for indirect, incidental, or consequential damages—including lost profits, data, or goodwill—arising from your use of our services.
We're not responsible for text message delivery failures, delays, or technical issues. Those are on your carrier.
Our total liability is capped at what you paid us in the twelve months before any claim.
9. Indemnification
You agree to defend us against claims arising from your use of our services, your violation of these terms, or your violation of anyone else's rights. This includes covering our legal fees.
10. Termination
We can suspend or terminate your access at any time, with or without notice. If we do, you lose access immediately and we may delete your data.
11. Governing Law
These terms are governed by Delaware law. Disputes go to Delaware courts.
12. Changes
We can modify these terms anytime. We'll post updates here and note the date. If you keep using our services after changes, you accept the new terms.
13. Severability
If part of these terms is unenforceable, the rest still applies.
14. Entire Agreement
These terms and our Privacy Policy are the full agreement between us.
